1. Who we are
Construct Desk ("we", "us") operates this website and provides our services. By using this website or ordering our services you are contracting with Construct Desk.
2. Acceptance
By accessing or continuing to use our website and services you agree to these Terms. If you do not agree, please do not use the service.
3. Our services
We provide construction quantity takeoffs, priced estimates, construction schedules and project-specific quality control plans prepared from the drawings and information you provide. Every request receives an individually reviewed quotation; work begins only after you accept the quotation and pay. Deliverables are professional estimates and planning documents and depend on the accuracy and completeness of the information supplied.
4. Your account and information
You must be of legal age or authorised to act for your organisation, provide accurate information, keep your login credentials confidential, and are responsible for activity under your account.
5. Acceptable use
You must not misuse the service, including by:
- using it for any unlawful purpose or in breach of any law;
- fraud, impersonation, spam or misleading submissions;
- uploading material that infringes the intellectual property or other rights of others;
- interfering with security, introducing malware, probing, scraping or attempting to bypass access controls;
- reverse engineering, reselling or redistributing the service.
6. Intellectual property
Construct Desk owns the website, software, documentation, templates and ConstructDesk branding. You keep ownership of drawings you upload and grant us a limited licence to store and process them solely to provide the service. On full payment you may use the delivered documents for your own project.
7. Payments, billing and refunds
Payments are processed securely by Stripe; we never store your card details. All fees are one-time payments for an accepted quotation. Refunds are covered in our Refund Policy.
8. Service level and warranties
We aim for accurate, timely work, but we do not guarantee uninterrupted or error-free operation of the website. Our quotation turnaround target applies to quotations only. To the fullest extent permitted by law, all implied warranties, including merchantability and fitness for a particular purpose, are disclaimed.
9. Liability
Our total liability is limited to the fees you paid for the relevant order in the previous 12 months. We are not liable for indirect or consequential losses, such as loss of profit, data or goodwill. Nothing limits liability for fraud, death or personal injury where the law does not allow it.
10. Suspension and termination
We may suspend or end your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, you may request copies of delivered files within 30 days, after which data may be deleted in line with our Privacy Notice.
11. General
These Terms are governed by the laws of the Commonwealth of The Bahamas, and its courts have jurisdiction. We are not responsible for delays caused by events beyond our reasonable control. You may not assign these Terms without our consent; we may assign them as part of a merger or sale.
